These Terms of Use ("Terms") govern your access to and use of the website, portal, courses, and services (collectively, the "Services") operated by Deltabyte Solutions IT Institute (OPC) Private Limited, trading as "DBS IT Institute" ("we", "us", "our", or "the Institute"). By registering, enrolling, applying for a franchise, or using any part of the Services, you agree to be bound by these Terms.

1. About the Institute

DBS IT Institute is a brand of Deltabyte Solutions IT Institute (OPC) Private Limited, a company incorporated under the Companies Act, 2013 (incorporated on 25 September 2024), with its registered office at 2nd Floor, Dharampur Chowk, Ward No. 05, Tajpur Road, Samastipur, Bihar – 848101, India. The Institute is a Startup India recognised entity (DIPP186877), an ISO 9001:2015 certified organisation, and the proprietor of the registered trademark "DBS IT" (Trade Mark No. 6328510, Class 42).

2. Eligibility and Accounts

• You must provide accurate, complete, and current information during registration.
• Where the applicant is a minor, a parent or legal guardian must register and provide consent on their behalf.
• You are responsible for maintaining the confidentiality of your login credentials, OTP, and wallet PIN, and for all activity under your account.
• You must promptly notify us of any unauthorised use of your account.

3. Services & Facilities Provided

The Institute provides a comprehensive digital education and management platform. The facilities available include, but are not limited to, the following.

3.1 Facilities for Students (A to Z)

• Online Registration: self-registration through the website or through a study centre, with a unique registration number.
• Courses & Programs: access to job-oriented IT and computer courses, syllabus, and prospectus.
• Study Material: access to course-related study materials made available through the student portal.
• Live Classes: participation in scheduled online/live classes, where offered.
• Student Portal & OTP Login: a secure personal portal accessed via OTP to view records and documents.
• Admit Cards: issuance and download of examination admit cards.
• ID Cards: issuance of student identity cards.
• Marksheets: generation and download of marksheets after examination and assessment.
• Certificates: issuance of course completion certificates and typing certificates.
• Online Verification: public verification of registration, ID card, marksheet, certificate, and typing certificate for authenticity.
• Fee Payment & Invoices: online fee payment, installment tracking, and downloadable invoices/receipts.
• Notifications: important notices, results, and updates via portal, email, and SMS.
• Support: raising and tracking support tickets and grievances.
• Store: access to the online store for relevant products/services, where available.

3.2 Facilities for Franchise Partners (A to Z)

• Franchise Application & Authorisation: apply to become an authorised centre; issuance of authorisation letters and franchise verification.
• Centre Management Panel: a dedicated admin panel to manage students, courses, and centre operations (subject to feature control per centre).
• Student Registrations: register and manage students under the centre.
• Document Generation: generate certificates, marksheets, typing certificates, admit cards, and ID cards for the centre's students.
• Attendance & Study Material: manage attendance and share study material.
• Live Classes & Fee Collection: conduct live classes and collect fees online.
• Wallet System: centre wallet with top-ups, transaction history, and withdrawals subject to applicable charges and rules.
• Micro-site / Centre Website: a centre-level web presence, where offered.
• Reports & Analytics: access to dashboards, reports, and activity logs.
• Notifications & Announcements: receive announcements from the head office and send notices to enrolled students.
• Subscriptions: access to plans and features on a subscription/upgrade basis, where applicable.

4. Fees, Payments and Wallet

• All fees, charges, and prices are displayed on the platform and must be paid through the approved payment methods.
• Wallet top-ups, withdrawals, and transfers are subject to the Institute's rules, minimum/maximum limits, and applicable charges.
• Wallet withdrawals and certain transactions may require a wallet PIN for security.
• Taxes (such as GST), where applicable, are charged in addition as per law.

5. Certificates, Marksheets and Verification

• Certificates, marksheets, and other documents are issued based on the student's enrolment, attendance, and successful completion/assessment as determined by the Institute or its authorised centre.
• The Institute provides an online verification facility. Any document that cannot be verified through the official platform should not be relied upon as genuine.
• The Institute reserves the right to withhold, cancel, or revoke any document obtained through fraud, misrepresentation, or violation of these Terms.

6. Acceptable Use

You agree not to:

• Provide false, misleading, or fraudulent information.
• Forge, tamper with, or misuse any certificate, marksheet, or document.
• Attempt to gain unauthorised access to any account, system, or data.
• Upload or transmit any unlawful, harmful, or infringing content.
• Use the Services in any manner that violates applicable law or these Terms.

7. Intellectual Property

All content on the platform, including the "DBS IT" trademark and logo, text, graphics, software, and course material, is owned by or licensed to the Institute and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written permission. The registered trademark "DBS IT" (Trade Mark No. 6328510) may not be used without authorisation.

8. Franchise Relationship

Nothing in these Terms creates a partnership, agency, or employment relationship between the Institute and any franchise partner or student. A franchise partner's rights and obligations are additionally governed by the separate franchise/authorisation agreement executed between the parties, which shall prevail in case of conflict on franchise-specific matters.

9. Suspension and Termination

We may suspend or terminate your access to the Services, with or without notice, if you breach these Terms, engage in fraud or misuse, or where required by law. Upon termination, your right to use the Services ceases, though certain provisions (including those relating to intellectual property, liability, and dispute resolution) shall survive.

10. Disclaimers and Limitation of Liability

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, the Institute shall not be liable for any indirect, incidental, or consequential damages arising from the use of, or inability to use, the Services. Our total liability for any claim shall not exceed the amount of fees actually paid by you to the Institute for the specific service giving rise to the claim.

11. Indemnity

You agree to indemnify and hold harmless the Institute, its directors, employees, and authorised centres from any claim, loss, or liability arising out of your breach of these Terms or misuse of the Services.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the competent courts at Samastipur, Bihar, India.

13. Changes to These Terms

We may revise these Terms at any time. The updated Terms will be posted on this page with a revised date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
